Since May 1, new cars must retain data in the event of an accident. What you need to know about what is recorded.
Big brother or storm in a teacup? From May 1, all new vehicles (car, vans, trucks, bus, etc.) must be equipped with an “event data recorder” under the European Union Regulation 2019/2144. Cet Event data recorder (EDR) is an electronic brain capable of retaining some data about your car and your driving in the event of a collision. The text justifies this device by evoking a “precious step to obtain more precise and more detailed accident data”.

Point 4 of article 6 details the information retained by the software: vehicle speed, braking, position and inclination of the vehicle on the road, the status and activation rate of all safety systems, the in-vehicle eCall system based on the 112 service, the activation of the brakes and any other relevant input parameter of the in-vehicle active safety and avoidance systems accidents”. The data therefore concerns braking, speed or wearing a seat belt. Contrary to what is used in airplanes, your conversations in the cabin will not be picked up, nor kept. Your GPS position is not recorded either.

The text also details the time limits of the recording: “a short interval of time before, during and immediately after a collision”. In this case it is about 30 seconds before the crash and 10 seconds after the crash. If you do not have an exit from the road or contact with another road user, the information will be “overwritten” by the news.
“Event data loggers should operate according to a closed loop system ” specifies the rules. This means that the data cannot be transmitted, directly, to the manufacturer or to the insurance companies. Lanonymized data may be processed by the authorities, but only to better understand the accidents.
